Legislation Would End the Aquarium Trade in Hawaii

Hawaii has proposed six bills that directly target the aquarium trade. One bill (SB 670) also impacts pet birds and other animals transported by air.  Animal rights activists have targeted the marine aquarium trade in Hawaii and think that they have a friendly enough legislature to push through their agenda.  Many of these proposals start from an assumption that the fishing associated with the pet industry is hurting the local population of native species that is completely disproven by science.  Since the animal rights community has a long history of never letting facts or reason get in the way of an emotional argument, we need to remain vigilant.

The proposed bills in question are:

  1. HB 606 – Establishes a 10-year moratorium on the taking of aquarium fish and “provide assistance, training, and related employment services to workers dislocated by the moratorium.”
  2. SB 322 – Criminalizes the sale of aquatic life for aquarium use “taken from any of the waters within the  jurisdiction of the State:”
    1. For a first offense, shall be fined not more than $1,000 or thirty days imprisonment, or both;
    2. For a second offense within five years of a previous violation, shall be fined not more than $2,000 or sixty days imprisonment, or both; and
    3. For a third or subsequent violation within five years of a previous violation, shall be fined not more than $3,000 or ninety days imprisonment, or both.
    4. In addition to any other penalty imposed under this section, a person violating this section shall be subject to:

i. An administrative fine of not more than $1,000 for each aquatic life specimen sold;

ii. Seizure and forfeiture of any taken aquatic life specimens, commercial marine license, vessel, and equipment; and

iii.Assessment of administrative fees and costs, and attorney’s fees and costs.

  1. HB 873 – Prohibits the sale of aquatic life for aquarium purposes use “taken from any of the waters within the jurisdiction of the State”. This bill is nearly identical to SB322 in the Senate.
  2. HB 883 – Mandates collection, shipping, and holding practices that would make it impossible to care for fish in a humane manner.
    1. “Cruel treatment” means:

i.Surfacing at a rate resulting in physical damage to the body tissue;

ii. Piercing or deflating the swim bladder;

iii. Cutting the fin or spine;

iv. Withholding food for more than twenty-four hours; or

v.Holding fish or aquatic life in less than one gallon of water, per each specimen, within any container.

  1.  SB 1340 – Similar to HB 883 in banning collection, shipping, and holding practices that would make it impossible to care for fish in a human manner.
  2. SB 670 – Imposes a number of restriction on the transport by air of all animals.
    1. all coldblooded and warm-blooded animals

i.Feeding coldblooded animals within 8 hours and warm-blooded animals within 2 hours of delivery to the carrier unless otherwise required by law or specified in the IATA Live Animal Regulations

ii.Duplicate feeding and water certificates attached to the container AND to the air waybill

  1. Airlines would have to

i.Ensure that the temperatures in cargo holding area not exceed 85F

ii.Transfer any animal from the aircraft cargo hold to the department of agriculture airport office for transpacific arrivals or for interisland flights to the baggage claim area within 20 minutes of aircraft “stopped and chocked upon landing.”

  1. For all “non-domesticated wild-birds,” the airline must receive a “live bird certification” that the birds “were born or bred in captivity on special farms” or shipped from/to a zoo, sanctuary, preserve, rehab center of government agency.

Where things stand:

Any of these bills could devastate the aquarium trade in Hawaii.  We at PIJAC, in close cooperation with our local members, are tracking the progress of these proposals.  None are currently scheduled for hearings so we are encouraged that most of Hawaii’s legislators understand the huge impact that these proposals could have on the local economy (a concern that means nothing to the animal rights zealots).  Please watch for further communications from PIJAC, as we will be reaching out and asking for a rapid and overwhelming response should it appear that any of these proposals are gaining traction.

Behind the wild success of SDC are the Cohen brothers and their partner, Brad Remmer. SDC’s Youth Education Program


SDC has been reaching out to youth programs for over 20 years.  We regularly invite schools, camps and other educational institutions to come and visit SDC.  We even pack up our critters for field trips.  SDC believes that education is the foundation for future hobbyists.  During our tours and field trips, we educate the children on the importance of sustainable collection, proper handling and  husbandry techniques.  SDC is proud of our education program and we look forward to the opportunity to teach young aquarists for years to come.

Based on the award-winning A350/A350W platform, winner of the Reef Builders 2012 LED Showdown, the A360 series brings new features and innovations to the industry and raises the bar for the competition.

The A360 features Kessil’s new proprietary Kessil Logic™, a unique form of spectral intelligence developed for precise color blending and optimal coral growth. In this new design, instead of varying the light intensity of two different channels to find the desired color and intensity mix, users can select the perfect spectrum and color with one knob and then adjust the intensity with the other. Kessil Logic™ will not only dramatically improve the user experience, it will also boost the light output at both ends of the spectral tuning range by as much as 30%.

In addition to its enhanced manual control-ability, the A360 comes with a pair of ports that allows the fixture to be governed by external devices. This new control interface operates within a 0-10VDC range, making it compatible with several popular aquarium external controllers.
